1. Introduction
These Terms and Conditions govern the use of the website paulo-morais.pt and the health care and performance services offered by Consciênciavaliativa Unipessoal Lda (NIF: 517409241, hereinafter "The Entity"). By registering or actively using the services, the user accepts these provisions in full, constructed under Portuguese legislation and European Union consumer law directives.
2. Service Provision, Prices and Billing
The Entity undertakes to provide Osteopathy and Training services based on a rigorous clinical evaluation of the user. All fees and prices associated with the different treatments will be clearly communicated in advance. The values presented include VAT at the legal rate in force, when applicable (strict health services may be exempt, under Article 9 of the CIVA in Portugal).
3. Right of Contractual Resolution (Cooling-off)
According to the EU Consumer Rights Directive (Directive 2011/83/EU), the user holds the right of free resolution ("cooling-off period") within 14 days in relation to packages of treatments purchased at a distance. Given the nature of the service provided (health/in-person evaluation), if the service is fully or partially executed with the user's prior and informed consent during this 14-day period, it is understood that the right to resolution loses its effect on sessions already processed.
4. Standards of Conduct and Permitted Use
The user undertakes not to falsify their identity or medical data, this responsibility being central to their clinical well-being. The user must, additionally, use the website and booking agenda ethically and in strict compliance with national laws, and abusive network practices are not allowed.
5. Intellectual Property
All literary content and media on this site belong to the Entity. Interface design, software, and logos are intellectual property licensed to the entity or the exclusive property of the producing agency (Elysium λ Development & Research). No reproduction is authorized without prior written consent.
6. Limitation of Liability
The Entity acts with the full degree of clinical responsibility required for practitioners in the EEA. However, the Entity declines responsibility for aggravations derived from deliberate omission of prior comorbidities by patients or non-compliance with the medical indications passed on. Through the site, there is no liability for technical or network failures beyond the operators' control.
7. Alternative Dispute Resolution (ADR) and ODR
Under EU law and Regulation (EU) No 524/2013, a simplified process for disputes is available, without the need to proceed judicially at first. European and national consumers can access the European Online Dispute Resolution (ODR Platform) provided by the European Commission at: ec.europa.eu/consumers/odr, or contact the National Information and Arbitration Center of Consumer Conflicts in Portugal (CNIACC).
